Petitioners, New Thoughts Finishing Company ("New Thoughts") and Travelers Insurance Company ("Travelers"), appeal the final order of the Benefits Review Board affirming the Administrative Law Judges award of compensation to respondent Donald Chilton under the Longshore and Harbor Workers Compensation Act ("the Act"), 33 U.S.C. Â§ 901, et seq. The ALJs award was affirmed as a matter of law when the Board did not act on the appeal within a year. See Omnibus Appropriations for Fiscal Year 1996, Pub. L. No. 104-134, Â§ 101(d), 110 Stat. 1321-219 (enacted 1996). New Thoughts and Travelers filed a notice of appeal to this court pursuant to 33 U.S.C. Â§ 921(c).
